Purchase Regulations

1. General Provisions

1.1. These regulations define the rules for the sale of digital images and access to albums (MAXI) offered by WARTAi Prosta Spółka Akcyjna, ul. Sempołowskiej 40/2, 43-300 Bielsko-Biała, KRS: 0001135832, REGON: 540043712, NIP: 9372765910, e-mail: art@wartai.digital, tel.: +48 (insert phone number).

1.2. Sales are conducted through the WARTAi online platform.

1.3. The regulations apply to sales to both individual and business customers (B2B).

1.4. Definitions:

* Seller: WARTAi Prosta Spółka Akcyjna.

* Buyer: A natural or legal person making a purchase.

* Product: Digital image or access to an album (MAXI).

* Price: Gross or net amount (depending on the Buyer’s status) expressed in USD or PLN, including VAT.

1.5. Language of the agreement: English.

2. Terms of Contract Conclusion and Termination

2.1. Orders can be placed through the WARTAi platform.

2.2. Purchase confirmation (receipt or invoice) is issued electronically and sent to the Buyer’s email address.

2.3. The Product price includes the cost of electronic delivery.

3. Payment Methods and Terms

3.1. Payments can be made through online payment operators (e.g., Stripe, PayPal).

3.2. Payment term: Immediately after placing the order.

3.3. Fees for the hotel offer are expressed in USD ($10 per month per screen).

4. Complaints

4.1. The Buyer may file a complaint within 14 days from the date of purchase.

4.2. Complaints should be submitted electronically to: art@wartai.digital.

4.3. The complaint should include:

* Order number

* Description of the problem

* Buyer’s data

4.4. The Seller will process the complaint within 14 days and inform the Buyer of the outcome.

5. Final Provisions

5.1. Any disputes between the Seller and the Buyer will be resolved amicably, and in the absence of an agreement, by the competent common court.

5.2. These regulations are effective from 20.12.2024 and are available on the WARTAi website.

5.3. The Seller reserves the right to change the regulations, informing Buyers in advance.

Rules and regulations for access to albums

Access for club members

1.1 Members of the Art Connoisseur Club have free access to all MAXI albums available on the platform.
1.2 Access to the albums lasts according to the membership purchased:

One day
One week
One month
One year

Purchase of individual album access

2.1 Individual access is dependent of club membership.

Final provisions

3.1 These terms and conditions shall enter into force on the date of their publication on the website.
3.2 The platform reserves the right to change the terms and conditions and the prices of the albums. Users will be informed of any changes well in advance.

  2. Affiliate Program

    • Full name or company name
    • Email address
    • Details required for commission payouts (e.g., bank account number)
    • Statistical data related to affiliate activity

    Purpose of Processing: Calculating commissions and managing the affiliate program.

  3. Auctions

    • Full name
    • Email address
    • Information about bids placed during the auction
    • Payment details (processed by an external payment provider)

    Purpose of Processing: Managing the auction process, contacting participants, and processing payments.

Legal Basis for Data Processing

Processing your personal data is based on:

  • Article 6(1)(b) of the GDPR – necessary for the performance of a contract (membership, auctions, affiliate program)
  • Article 6(1)(c) of the GDPR – legal obligations (e.g., accounting)

Who Do We Share Data With?

Your data may be shared only with:

  • Payment processors – to complete transactions (e.g., Stripe, PayPal)
  • Technical partners – such as hosting providers and tools for managing memberships and affiliate programs (e.g., MemberPress)
  • Authorized entities as required by law

How Long Do We Keep Your Data?

We will retain your data:

  • For the duration of the contract (membership, affiliate program, auctions)
  • After the contract ends – for the period necessary to comply with legal obligations and to pursue claims (e.g., accounting – 5 years)

Affiliate Program Terms and Conditions.

Welcome to WARTAi Affiliate Program! As an authorized affiliate (Affiliate) of WARTAi you agree to abide by the terms and conditions outlined in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting our platform as an Affiliate.

By joining the Affiliate Program (Program), you become part of our mission to promote the beauty and creativity of art. Your role is to legally advertise our website and offerings, earning commissions on memberships and products purchased by individuals referred to us through your unique affiliate link.

By signing up for the WARTAi Affiliate Program, you indicate your acceptance of this Agreement and its terms and conditions.

  1. Approval or Rejection of the Application
    We reserve the right to approve or reject any Affiliate Program Application at our sole discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.
  2. Commissions Affiliates will earn 30% commission on all eligible sales referred through their affiliate link, including memberships, albums, and other artistic products.

Commissions are paid once a month for transactions that remain active and are not subject to refunds or chargebacks for a minimum of 37 days.
You cannot refer yourself, and commissions will not be paid on your own purchases.
Only one commission will be paid per referred customer. If a referred customer places multiple orders, the commission applies only to the first eligible order.

3. Termination
Your participation in the Program may be suspended or terminated for any of the following reasons:

  • Inappropriate advertising (false claims, misleading links, or unauthorized materials).
  • Spamming (mass emails, newsgroup postings, or unsolicited messages).
  • Advertising on platforms that promote illegal, offensive, or harmful activities.
  • Failure to disclose the affiliate relationship where required by law or regulations.
  • Violation of intellectual property rights, including the unauthorized use of WARTAi logos, trademarks, or other branding.
  • Offering incentives, rebates, or discounts from your affiliate commissions as an inducement to buy (however, bundling other products with promotions is acceptable).
  • Engaging in self-referrals, fraudulent transactions, or suspected affiliate fraud.
    We reserve the right to terminate any Affiliate account at any time, with or without cause, if we believe the Affiliate is in violation of this Agreement.

4. Affiliate Links
You may use the affiliate links and banners provided by us or create your own, as long as they comply with our guidelines.
Affiliates may promote WARTAi on their websites, social media, blogs, email newsletters, or other approved platforms.
All affiliate promotions must align with the mission and values of WARTAi and must not misrepresent our offerings.

5. Prohibited Practices for Coupons and Deals
Affiliates may not create or promote unauthorized coupons or discounts for WARTAi.
Any misleading text, pop-ups, or deceptive practices related to coupons are strictly prohibited.
All promotions involving discounts must be pre-approved by Windows of Art.

6. Pay Per Click (PPC) Policy
PPC advertising for Windows of Art is not permitted without prior written approval. Affiliates may not bid on branded terms, including WARTAi memberships, or related keywords.

7. Liability
WARTAi is not responsible for indirect or accidental damages (e.g., loss of revenue or commissions) due to tracking failures, database errors, or other technical issues.
We do not guarantee error-free operation of the Affiliate Program or our website.
Affiliates are responsible for ensuring that their promotional practices comply with this Agreement and applicable laws.

8. Term of the Agreement
This Agreement is effective from the moment you are approved as an Affiliate and remains in effect until terminated by either party. We reserve the right to update or modify this Agreement at any time. Continued participation in the Program after changes are made constitutes your acceptance of the updated terms.

9. Indemnification
Affiliates agree to indemnify and hold harmlessWARTAi, its officers, directors, employees, and agents from any claims, damages, or liabilities arising from:

  • Misrepresentation or negligence on the part of the Affiliate.
  • Violation of laws or regulations.
  • Breach of this Agreement.

10. Governing Law and Jurisdiction
This Agreement is governed by the laws of the jurisdiction in which WARTAi operates. Any disputes will be resolved exclusively in the courts of the applicable jurisdiction.

11. Electronic Signature
By completing the affiliate application process, you agree to the terms of this Agreement. Your application and participation in the Program constitute an electronic signature that is legally binding and equivalent to a handwritten signature.
